Terms and conditions of sale

1. ORGANIZATION AND ORGANIZATION OF THE SALE: Crédit Municipal de Paris public auctions are judicial sales conducted by the auctioneers attached to the establishment as appraisers. The items offered for sale have been previously pledged to Crédit Municipal de Paris and have been registered for sale by virtue of an order of the President of the Paris Judicial Court. Unless otherwise stated, they are second-hand items within the meaning of article L.321-1 of the French Commercial Code.
An exhibition prior to the sale enables buyers to examine the condition of the items offered for sale. The information given in the catalog is the responsibility of Crédit Municipal de Paris, subject to any rectifications announced at the time of presentation of the item and recorded in the sale report.
Restorations, alterations, accidents, dimensions and weights of items are given to the best of our ability. They are given only as an indication to facilitate the inspection of the potential buyer and remain subject to his personal appreciation. The absence of any indication in no way implies that an item is free of defects. No claims will be accepted once the sale has been announced. The sale will take place in the order of the catalog. The estimate for each item is only an indication. The highest and last bidder will be the successful bidder. He must give his name and address. The sale is made expressly in cash and in euros.

2. SALE COSTS: The successful bidder undertakes to pay the hammer price personally and immediately. In addition to the auction price, the buyer must pay a non-degressive fee of 18.00%, inclusive of tax.

3. METHOD OF PAYMENT AND DELIVERY OF LOTS :

3.1. Payment may be made:
- In cash: up to €1,000 if the bill does not exceed €1,000 (including charges);
- By credit card (national or international);
- By bank transfer.

3.2. Transportation is the responsibility of the purchaser. No shipment will be organized by
Crédit Municipal de Paris or the appraising auctioneers at Crédit
Municipal de Paris. Purchasers who wish to have their item delivered to the carrier of their choice will be sent a special mandate discharging their liability.

3.3. The delivery of lots is immediate in the case of payment in the auction room in cash
(up to €1,000), or by national or international bank card. For all other means of payment, delivery is deferred until receipt of payment.
For payments made via the Interencheres or Auction websites, delivery of lots can only take place the day after the sale. If the sale takes place on a Saturday, delivery of lots will be possible from the Tuesday following the sale.

Lots can be collected from the Crédit Municipal de Paris debit department at the following times:
- 9am to 5pm on Crédit Municipal de Paris opening days.

As an exception, bottles of wine purchased at auction can only be collected by appointment by telephone on 01.44.61.65.14 or by e-mail sent to : See email with receipt.

3.4. The structure of the auctioneers appraised by Crédit Municipal de Paris will provide free storage for 60 days. After this period, storage charges will be invoiced when the lots are collected, as follows:
- €10 excl. tax/lot/week for a volume greater than 1m3;
- €7 excl. tax/lot/week for a volume less than 1m3;
- €5 excl. tax/lot/week for a volume that fits in the palm of your hand.

4. PURCHASE ORDERS AND TELEPHONE REQUESTS: The auctioneers appraised by Crédit Municipal de Paris and the experts are responsible for executing, free of charge, purchase orders entrusted to them by bidders unable to attend the sale. Under no circumstances can they be held responsible for any failure or problem in the telephone connection, as the purchase order is merely a facility offered to the customer.
Purchase orders must be sent to the appraising auctioneers at Crédit Municipal de Paris no later than 24 hours before the sale:

Whatever the method of transmission of the purchase order, the bidder's contact details and a photocopy of an identity document must be left with the auctioneer. The appraising auctioneers at Crédit Municipal de Paris reserve the right to refuse a request if the bidder does not provide sufficient guarantees. In the case of purchase orders of the same amount for the same lot, the order submitted first will be preferred. If a last bid in the room is equal to a written order, the lot will be awarded to the person present in the room.

5. SPECIFICITIES OF AUCTIONS LINKED TO CERTAIN SALES :

5.1. Sale of jewelry and gold lots

The weight, dimensions, restorations, modifications to the jewels and gold lots, and technical characteristics are given to the best of our ability. They are given only as an indication to facilitate the inspection of the potential buyer and remain subject to his personal appreciation. Crédit Municipal de Paris cannot be held responsible for any omissions that may occur despite the precautions taken. The technical characteristics of jewelry and gold lots mentioned in the catalog, such as titration and its distribution, are given for information only and have no contractual value. Crédit Municipal de Paris accepts no responsibility for them. Precious and fine stones may have undergone treatments designed to enhance their value (e.g. oiling of emeralds, heat treatment of rubies and sapphires, whitening of pearls). These treatments are traditional and accepted by the international jewelry market. Stones presented for sale without a certificate are sold without any guarantee of treatment.
Indications concerning the origin of stones and quality (color and purity of diamonds) reflect the opinion of the laboratory issuing the certificate. No claims will be accepted if another laboratory issues a different opinion.

5.2. Sale of watches

The weight, dimensions, restorations, modifications, technical characteristics and serial numbers of the watches are given to the best of our ability. No warranty is given on the condition of the watches and their bracelets. Revisions, adjustments and water-resistance are the responsibility of the purchaser. Lots marked with an asterisk (*) have been made from parts of Crocodylidaes spp or Alligator mississippiensis species classified in appendices II/B of the Washington Convention and rule 338/97 of 09/12/1996. For export from the EU, an export CITES permit is required, at the expense of the future buyer.

5.3. Sale of wine bottles

The level of the bottle and the condition of the label are given to the best of our ability. They are given only as an indication to facilitate the inspection of the potential buyer and remain subject to his personal appreciation.

5.4. Sale of works of art

As the public exhibition has enabled us to examine the works offered for sale, no claims will be accepted concerning dimensions, accidents and restorations, which are given for information only.
The condition of the frames is not guaranteed.

6. LIVE AUCTION VIA WWW.INTERENCHERES-LIVE.COM and WWW.AUCTION.FR

There is no additional charge for judicial lots: 18.00% VAT incl. buyer's costs. To bid online during a sale, the customer must register on www.interencheres-live.com, to bid on Interencheres, or www.auction.fr, to bid on Auction, and make a credit card imprint (neither the credit card number nor its expiry date are kept). By doing so, the customer accepts that www.interencheres-live.com and www.auction.fr may provide the auctioneers with all the information relating to the customer's registration, as well as the customer's credit card imprint. The auctioneers appraised by Crédit Municipal de Paris reserve the right to request, if necessary, additional information before final registration for online bidding. All online bids are subject to the common law governing public auctions and will be considered as an irrevocable commitment to buy. There is no right of withdrawal. Under no circumstances can Crédit Municipal de Paris or the auctioneers be held responsible for poor Internet connections. For certain sales, a deposit may be required prior to registration. If the bid is not accepted by the bidder or registrant, the deposit will not be debited. In the case of the successful bidder, the deposit will be debited from his account and will be deducted from the balance payment. In the event of non-payment of the balance of the lot(s) won, the deposit will not be reimbursed to the successful bidder. Online bidders authorize the auctioneers appraised by Crédit Municipal de Paris to use their credit card imprint to pay for all or part of the purchase price, including the usual charges payable by the buyer. Shipping costs are the responsibility of the purchaser. The purchaser releases Crédit Municipal de Paris and the auctioneers from any liability for shipping costs. In the event of non-payment within one month of the sale, the sale will be cancelled and the item will be put up for sale again.

INCIDENTS IN PAYMENT - FICHIER DES RESTRICTIONS D'ACCÈS DES VENTES AUX ENCHERES (TEMIS)
Any auction slip that remains unpaid with Crédit Municipal de Paris, or that has been subject to a delay in payment, is liable to registration in the Fichier des restrictions d'accès aux ventes aux enchères ("TEMIS File") set up by Commissaires-Priseurs Multimédia (CPM), a French limited company (société anonyme) with a Board of Directors, having its registered office at 37 rue de Châteaudun, 75009 Paris, registered in the Paris Trade and Companies Register under number 437 868 425. Inclusion in the TEMIS File may result in a limitation of the bidder's ability to bid with TEMIS Professional Subscribers, refusal to participate in Crédit Municipal de Paris auctions, and temporary suspension of access to the "Live" service of the www.interencheres.com platform and the Auction.fr platform managed by CPM, in accordance with the general terms and conditions of use of these platforms.

7. SECRET PURCHASE ORDERS VIA WWW.INTERENCHERES-LIVE.COM and WWW.AUCTION.FR

The auctioneers appraised by Crédit Municipal de Paris have no knowledge of the maximum amount of orders placed via Interencheres or Auction. Bids are formed automatically and progressively within the limit set by the bidder. The execution of the order adapts to the bidding speed according to the current bids. The bidding step is defined by the following intervals:
- up to €19: €5;
- from €20 to €199: €10;
- from €200 to €499: €50;
- from €500 to €999: €100;
- from €1,000 to €4,999: 200€;
- from 5,000€ to 9,999€: 500€
- from 10,000€ to 19,999€: 1,000€;
- from 20,000€ to 49,999€: 2,000€;
- from 50,000€ to 99,999€: 5,000€;
- 100,000€ and over: 10,000€.

By placing a secret purchase order, the successful bidder authorizes the auctioneers appraised by Crédit Municipal de Paris to use his or her credit card imprint to pay for all or part of the purchase price, including the usual charges payable by the buyer.

8. PERSONAL DATA: The buyer's or bidder's personal data (online or in the auction room) is used jointly by Crédit Municipal de Paris and the appraising auctioneers at Crédit Municipal de Paris for the management of auction sales (registration, auction operations, payment and collection), to meet legal and regulatory obligations relating to the internal controls of financial institutions, as well as for customer loyalty and internal management operations (statistics). This data is intended for use by authorized members of Crédit Municipal de Paris and by auctioneers appointed by Crédit Municipal de Paris. Data relating to buyers is kept by Crédit Municipal de Paris and the appraising auctioneers at Crédit Municipal de Paris for a period of 10 years from the end of the commercial relationship. Customers have the right to access, rectify, oppose, limit, delete and port their data, which they may exercise by sending a request to Crédit Municipal de Paris, Délégué à la protection des données, 55 rue des Francs-Bourgeois, 75004 Paris or by e-mail(see e-mail). If the Customer considers that his/her rights have not been respected, he/she may lodge a complaint with the CNIL.
